DECISION No. 133/2004/QD-TTg OF JULY 20, 2004 AMENDING A NUMBER OF ARTICLES OF DECISION No. 115/2001/QD-TTg WHICH HAS APPROVED THE MASTER PLANNING ON DEVELOPMENT OF VIETNAM'S CONSTRUCTION MATERIALS INDUSTRY TILL 2010 THE PRIME MINISTER Pursuant to the Law on Organization of the Government of December 25, 2001; At the proposals of the Ministry of Construction in Official Dispatch No. 793/BXD-VLXD of May 28, 2004, the Ministry of Natural Resources and Environment in Official Dispatch No. 1229/BTNMT-TD of April 22, 2004, and the Ministry of Health in Official Dispatch No. 4911/YT-DP/AIDS of July 7, 2004; and comments of the concerned ministries and branches, DECIDES: Article 1.- To amend a number of articles of Decision No. 115/2001/QD-TTg of August 1, 2001 as follows: 1. To amend Point c, Clause 3 of Article 1 as follows: c/ Roofing materials: To develop and stabilize the production of assorted materials suitable to the natural conditions and customs of each region. To encourage investment in the development of non-baked roofing tiles in regions where high-quality clay is unavailable, such as the northern mountainous region, the Central Highlands and the southern Central Vietnam. The construction materials industry should devise plans for research into, production and use of diversified roofing-sheet products from assorted asbestos materials. To prohibit the use of amphibole asbestos (brown and blue asbestos) in the production of roofing sheets. The establishments producing roofing sheets from asbestos must strictly satisfy the requirements on environmental and healthcare standards; not to make new investment in or expand the establishments producing roofing sheets from cryzotyl asbestos. 2. To amend Clauses 2 and 7 of Article 2 as follows: 2. The Ministry of Trade shall coordinate with the concerned ministries and branches in studying and proposing non-tariff measures for the protection of domestic production after Vietnam fulfills its AFTA commitment. To tightly control the import of asbestos materials for the production of roofing sheets, and not to permit the import of amphibole asbestos into Vietnam. 7. The Ministry of Science and Technology shall coordinate with the Ministry of Construction in working out plans for stepping up scientific, technical and technological activities in the field of construction materials, aiming to absorb the world's and the region's technological and technical advances, raise the research and consultancy capability in the construction management, administration and supervision, technology transfer and market expansion. It shall also promulgate regulations on technology, technical standards and environment for management of the branch's development. The Ministry of Natural Resources and Environment shall coordinate with the Ministry of Health, the Ministry of Construction as well as the concerned ministries and branches in conducting environmental and medical inspection of roofing-sheet producing establishments and the quality of roofing-sheet products using asbestos, including cryzotyl asbestos. Article 2.- This Decision takes effect 15 days after its publication in the Official Gazette. Article 3.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the provincial/municipal People's Committees, the Managing Boards of State corporations, and the heads of the concerned agencies shall have to implement this Decision.
