Document Content body { font-family: Arial, sans-serif; margin: 20px; line-height: 1.6; } p { margin: 10px 0; } DECISION Authorizing the industrial parks management board of Thanh Hoa province to manage export, import and commercial activities of foreign-invested enterprises in industrial parks of Thanh Hoa province THE MINISTER OF TRADE Pursuant to the Government Decree No. 29/2004/ND-CP of January 16, 2004, on the functions, tasks, powers and organizational structure of the Ministry of Trade; Pursuant to the Regulation on Industrial Parks, Export-Processing Zones and Hi-Tech Parks issued together with the Government Decree No. 36/CP of April 24, 1997; Pursuant to the Prime Minister's Decision No. 39/1999/QD-TTg of March 6, 1999, establishing the Industrial Parks Management Board of Thanh Hoa province; Having considered the proposal of the People's Committee of Thanh Hoa province in Official Letter No. 4284/UBND-KTTC of October 19, 2005, DECIDES: Article 1.- To authorize the Industrial Parks Management Board of Thanh Hoa province (hereinafter referred to as the Management Board for short) to manage export, import and commercial activities of foreign-invested enterprises and parties to business cooperation contracts that invest in industrial parks of Thanh Hoa province (hereinafter referred to as foreign-invested enterprises for short). Article 2.- The Management Board shall approve import plans and manage commercial activities of foreign-invested enterprises according to the following contents: 1. The Management Board shall approve import plans of foreign-invested enterprises, ensuring the strict compliance with the November 12, 1996 Law on Foreign Investment in Vietnam, the June 19, 2000 Law Amending and Supplementing a Number of Articles of the Law on Foreign Investment in Vietnam, the Government Decree No. 24/2000/ND-CP of July 31, 2000, and Decree No. 27/2003/ND-CP of March 19, 2003, the Prime Minister's Decision No. 46/2001/QD-TTg of April 4, 2001, on goods export and import management in the 2001-2005 period, relevant legal documents, and their investment licenses, business permits, econo-technical explanations, and technical designs. The approval of import plans covers the following contents: 1.1. Approval of import plans and certification of the exemption from import tax for machinery, equipment, means of transport, construction supplies, and spare parts used for the formation of fixed assets, including those imported by mode of financial hire-purchase. 2. Approval of plans on the temporary import of machinery, equipment and means of transport not included in technological lines, which are hired from abroad for enterprises' activities. 1.3. Approval of plans on the import of supplies and raw materials for enterprises' production and business activities. 2. It shall approve the liquidation of machinery, equipment, means of transport, supplies, and raw materials of foreign-invested enterprises according to the provisions of the Trade Ministry's Circular No. 01/2005/TT-BTM of January 6, 2005. 3. It shall approve plans on the import of finished products for combination with export products of foreign-invested enterprises. Article 3.- The Management Board shall send quarterly reports on export and import activities of foreign-invested enterprises, made according to the guidance of the Trade Ministry in its Circular No. 22/2000/TT-BTM of December 15, 2000. Article 4.- The Ministry of Trade shall periodically inspect the implementation of this Decision according to the provisions of law. Article 5.- This Decision takes effect 15 days after its publication in "CONG BAO."
